These Terms and Conditions (“Terms”) govern your use of the Squeekypeas website and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms then you may not access or use the Service.

1. Users

The Service is intended for use by:

• Parents, Carers and Educators: You can browse and search for activities and events without creating an account.
• Activity/Event Providers: You need to create an account to list your offerings and connect with parents, carers and educators.

You may only create one account per email address. Creating multiple accounts with the same email address is prohibited. We reserve the right to terminate any accounts found to be in violation of this policy.

2. Location Information

We do not collect location-based information from users who are not providers. We use the location information supplied by providers to allow parents, carers and educators to search for activities and events in their area.

3. Content

User Content: You are responsible for all content you submit to the Service (“User Content”). You represent and warrant that you have all rights necessary to submit User Content and grant the licenses described in these Terms. Provider Content: Activity/Event Providers are responsible for the accuracy and completeness of the information provided about their offerings (“Provider Content”). In addition to the foregoing, by submitting Provider Content, you warrant and represent that you are authorized by the Provider you have registered, to list the Provider’s information and anything associated with the Provider on the Service.

Third-Party Content: The Service may contain links to third-party websites or services that are not owned or controlled by Squeekypeas. We are not responsible for the content or practices of any third-party website or service.

Intellectual Property Rights: Activity/Event Providers retain ownership of all intellectual property rights in their Provider Content. By submitting Provider Content to the Service, Providers grant Squeekypeas a non-exclusive, worldwide, royalty-free right to use, display, reproduce, modify, translate, and distribute such Provider Content on the Service. Providers represent and warrant that they have all necessary rights to grant such license.

4. Use of the Service

You agree to use the Service in a lawful manner and in accordance with these Terms.

User Conduct

You agree not to use the Service:

• For any illegal or unauthorised purpose.
• To infringe on the intellectual property rights of others.
• To transmit any harmful, harassing, malicious, defamatory, obscene, or threatening content.
• To disrupt or interfere with the Service or servers or networks connected to the Service.
• To impersonate any person or entity.

Provider Responsibilities

• Providers are responsible for the accuracy and completeness of their listings.
• Providers are responsible for complying with all applicable laws and regulations.
• Providers are responsible for ensuring the safety and well-being of participants in their activities and events.
• Bookings and payments are handled directly between parents, carers and educators and providers.
• We are not responsible for Provider Responsibilities, including the accuracy or completeness of content.

5. Disclaimer

The Service is provided “as is” and without warranties of any kind, express or implied. We disclaim all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranties, express or implied, about the accuracy, completeness, or reliability of the content on our Website. We do not warrant that the Service will be uninterrupted, secure, or error-free. We will use commercially reasonable efforts to provide the Service on a twenty-four-hour basis, seven days a week. However, we may occasionally need to conduct maintenance or repairs on the Service, or experience downtime due to unforeseen circumstances beyond our control. We will use commercially reasonable efforts to minimise such downtime. You acknowledge that the Service may be unavailable from time to time due to scheduled maintenance, unscheduled maintenance, or other factors beyond our control.

In no event shall We be liable for any damages (including, without limitation, direct, indirect, incidental, consequential, or punitive damages) arising out of or in connection with your use of the Service or the activities and events listed on it. User Indemnity

Provider Indemnity

In addition to the foregoing, Providers agree to indemnify and hold harmless Squeekypeas, its officers, directors, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, costs, and expenses (including attorney’s fees) arising out of or in connection with:

• Your Provider Content.
• Your activities and events listed on the Service.
• Your violation of these Terms.

9. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure is caused by an event beyond our reasonable control, such as acts of God, war, terrorism, strikes, or natural disasters.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Australia, Australia.

11. Dispute Resolution

In the event of a dispute arising out of these terms, we agree to attempt to resolve the dispute through mediation in South Australia. If mediation is unsuccessful, the dispute will be settled by binding arbitration in accordance with the rules of the Australian Arbitration Association. The arbitration will be conducted in South Australia.

12. Entire Agreement

These Terms constitute the entire agreement between you and Squeekypeas regarding your use of the Service.

13. Changes to the Terms

We may revise these Terms at any time by updating this page. We will notify you of any material changes to the terms such as by email or by posting a notice on the service.You are bound by any revisions and should therefore periodically visit this page to review the current Terms.
